Maryland law has specific guidelines for challenging a will or making a claim against an estate. When our attorneys administer an estate, we first formally open the estate, including filing a petition to probate an estate.

A personal representative is named, whose chief responsibility is to gather the assets of the deceased or decedent, and pay all appropriate claims, including taxes and distributions. Many claims can be disallowed or negotiated by our lawyers.

A will challenge case is technical, and demands experienced counsel who knows the elements of validity with a will and the aspects of the will and it's drafting that are most susceptible to challenge. We are prepared to develop a compelling case to protect your interests.

In most civil cases, for example, the plaintiff presents his or her arguments and evidence first. In will challenges, the defendant goes first, showing the court that the will was properly executed. That means that the plaintiff must have a very strong case in order to refute the defendant's evidence and demonstrate the invalidity of the will.

In a recent case, a bill was presented by a medical supply company for unpaid rent on a medical device. We were able to prove that the company was unlicensed, and the court denied it's request for payment, saving the estate thousands of dollars.
